Protecting your privacy is important to us. We therefore wish to make the following information available to you.

Legal basis and purpose

The processing of your personal data is based on your consent, which you can withdraw at any time without consequences (so-called revocation). We use the photos, audio and video recordings taken of you at a Medela event as well as the texts transcribed from them for internal and external communication and marketing purposes in any form and by any means (related to the topic (e.g. company websites, company intranet, company social media, print and online publications, promotion of future events, and for the purpose of sharing customer testimonials); the preceding list is not exhaustive.

We process the following categories of your personal data

  • Identification information (e.g. name, first name)
  • Professional information (e.g. function if applicable)
  • Photos, audio recording, film footage and texts transcribed from them

Recipients or categories of recipients

By publishing your personal data, your personal data can be viewed by the public.

Within Medela, your personal data will only be processed by those internal organizational units that process it for the purpose stated above. This may also include employees of our mother, sister or daughter companies. We may also share your personal data with service providers who help us to process your personal data for the above-mentioned purposes (e.g. photographer, platform for creating/editing videos/photos). Medela has entered into agreements with all these parties to ensure that your personal data is adequately protected. Service providers are not allowed to disclose your personal data to unauthorized third parties or to use your personal data for purposes other than those instructed.

Location and duration of storage of your personal data

Your personal data is stored on servers in Switzerland and the European Union. We keep your personal data until you notify us that you no longer consent with our use thereof. Personal data in already printed or published media can no longer be deleted.

Transmission of personal data abroad

The publication allows access to your personal data from anywhere in the world. This means that countries that do not guarantee the same level of data protection as in your country of residence can also access the data.

Some Medela companies and service providers are also located in countries that do not provide the same level of data protection as in your country of residence. Medela has entered into agreements with these Medela companies and service providers to ensure that all necessary measures are taken to protect your personal data in accordance with applicable requirements. The measures that we use to protect personal data are subject to the legal requirements of the jurisdictions where personal data is transferred, including lawful requirements to disclose personal data to government authorities in those countries.

U.S. State Law Requirements

Some U.S. state privacy laws such as the California Consumer Privacy Act (CCPA) and Virginia Consumer Data Protection Act (VCDPA), Colorado Privacy Act (CPA) and the Connecticut Personal Data Privacy and Online Monitoring (2022 S.B.6) require specific disclosures for state residents. State laws like the CCPA, VCDPA, CPA and 2022 S.B.6 also provide the right to request information about how we collect, use and disclose your information. These laws also provide the right to request deletion or anonymization. Medela does not discriminate against individuals for exercising these privacy rights. Medela’s Privacy Notice for California Residents supplements the information contained in this Policy and applies solely to visitors, users, and others who reside in the State of California.

Medela’s Privacy Notice for Virginia Residents supplements the information contained in this Policy and applies solely to visitors, users, and others who reside in the State of Virginia.

Medela Does Not Sell Personal Data

In the preceding twelve (12) months, we have not sold any Personal Data. We do not intend to sell any Personal Data in the future. If we change this intent, we will update this Privacy Notice accordingly. “Personal data" means any information that is linked or reasonably linkable to an identified or identifiable natural person. "Personal data" does not include de-identified data or publicly available information.

From time to time we may collect “Sensitive Personal Information” (SPI).  SPI includes, but is not limited to, racial origin, religious beliefs, sexual orientation, ethnicity, religion, genetic data, private communications, specified health information and precise geolocation. We do not sell SPI or utilize automated decision making.

How to exercise your privacy rights

You have the right, depending on the applicable local data protection law, to request information as to what data Medela holds about you (right of information) and to obtain access to those personal data (right of access), obtain the rectification of inaccurate data or, taking into account the purposes of the processing, request the completion of incomplete data (right to rectification), and, where certain requirements are met, obtain the erasure of personal data (right to erasure), obtain the restriction of processing (right to restriction of processing), receive and transmit to another controller the personal data which you provided to us (right to data portability), and object to the processing of your personal data on grounds relating to your particular situation (right to object).

Please note that the above-mentioned privacy rights cannot be guaranteed if there are exceptions by law or any regulations which do not allow us to process your requests on privacy rights.
